ASSISTANT DIRECTOR OF EXPORT CONTROLS

The Assistant Director of Export Controls works with the Director to ensure Duke's compliance with laws related to international trade and technology transfers. The person in this position is responsible for working with internal clients in determining the proper course of action to comply with regulations regarding exports, deemed exports, and international travel and is authorized to sign and submit license applications to the Departments of Commerce and State.

SPECIFIC DUTIES

Export controls administration:
# Review hardware, software, or technical data proposed for export by assigning appropriate Export Control Classification Numbers (ECCN) and making license determinations
# Prepare and submit license applications (import and export) to Departments of State, Commerce, Treasury, Energy, as well as US Fish and Wildlife, CITES, Nuclear Regulatory Commission, FDA, USDA, FAA, etc.
# Review and advise ORS/ORA on grants and contracts to ensure that Duke can operate under the Fundamental Research Exemption Negotiate with sponsor's export control representatives on preserving FRE
o Prepare Technology Control Plans based on the terms of the sponsor agreement
Prepare, analyze and document various contracting/compliance issues, such as NASA restrictions on collaboration with Chinese entities.
# Promote efficient shipping of equipment by providing advice to departments in order to ensure export compliance with government regulations and mitigate cost
Work closely with Duke's preferred Customs Broker
Recommend methods for the timely movement of goods around the world
# Conduct Restricted Party Screening for departments (ORS, ORA, OCRC, Procurement, DCRI, etc.) and develop solutions for relationships with debarred entities
# Research and certify to government agencies that Duke personnel are not debarred
# Work with the Office of Visa Services to certify, as part of the visa process, that incoming foreign nationals will not be exposed to controlled technologies without an export license.
# Monitor and participate in Duke Engineering Research Institute (DERI) programs to ensure compliance with regulations, and assist in development of policies for the Institute Training and monitoring for export awareness and compliance:
# Prepare and conduct export control awareness training throughout campus
# Develop reference materials for Duke staff to ensure compliance with regulations (e.g. FedEx Ship Manager instructions, ECCN summaries, Pre- Approved Shipment (PAS)procedures, etc.)
# Write and update policies and procedures related to export controls
# Conduct monitoring audits/reviews. Assess risk and carry out corrective action, if

# Draft quarterly Export Control Compliance Reports for Duke's Audit, Risk and Compliance Office.
# In conjunction with the Office of Federal Relations, Schools/Departments, COGR/AAU, and others, review proposed regulatory changes to assess impact on Duke, including submitting responses to the US government.
# Committee service and other duties as the need arises.

Minimum Qualifications
Education
Work requires a bachelor's degree in an accounting, scientific, allied health or related field of study. Master's degree preferred.

Experience:
At least 3 years in export compliance related field. Global research focus preferred.

Department Preferred Job Skill Requirements
# Firm knowledge of Export Administration Regulations (EAR),International Traffic in Arms Regulations (ITAR), and the Office of Foreign Assets Control (OFAC)regulations# Excellent written and verbal communication skills.
# Demonstrated ability to comprehend concepts and terms related to highbiotechnology, nanotechnology, encryption software, nuclear technology, technology such as semiconductor technology as well as other engineering and physics principles.

Licensing/Certification Job Requirements
Custom house Broker License encouraged
